Terms of Service

These terms govern access to and use of the Tire-Bouchon application and website. Please read them carefully: by creating an account or using the service, you accept them in full.

This is a translation. It is provided for information and for app store review. The French version is the only legally binding text; in the event of any discrepancy between the two, the French version prevails.

Excessive drinking is harmful to health. Please drink responsibly. The service is strictly reserved for adults (18 years and over). Tire-Bouchon is a cellar management and information tool; it in no way encourages excessive consumption.

01Purpose and acceptance

These Terms of Service (the “Terms”) set out the conditions under which the Tire-Bouchon application and website (the “Service”) are made available and used, as well as the rights and obligations of the parties in that context.

Use of the Service requires full and unreserved acceptance of these Terms. By creating an account, ticking the acceptance box, or using the Service in any manner whatsoever, you acknowledge that you have read, understood and accepted the Terms. If you do not accept them, you must refrain from using the Service.

02Definitions

  • Service: the application, the website, and all features offered by Tire-Bouchon.
  • User: any adult natural person holding an account or using the Service.
  • Account: the personal space associated with a unique handle (@handle) giving access to the Service.
  • User Content: any data published by the User (label photographs, tasting notes, submitted entries, comments, avatar, etc.).
  • Database: the reference set of wines, producers, appellations and related information maintained by Tire-Bouchon.

03Service publisher

The Service is published by ADVIJU INVESTISSEMENT, a simplified joint-stock company (SAS) with share capital of €1,000, registered with the Paris Trade and Companies Register under number 919 110 387 (head office SIRET: 919 110 387 00033 — EU VAT number: FR55 919 110 387), whose registered office is at 22 rue Durantin, 75018 Paris, France.

The Service is hosted by Vercel Inc. (340 S Lemon Ave #4133, Walnut, CA 91789, United States). User data is stored by Supabase on servers located in the European Union (eu-west region, Paris).

04Access and registration

Access to the Service requires the creation of an Account. The User undertakes to provide accurate, up-to-date information and to choose a unique handle. A given handle may be assigned to one person only.

Eligibility

The Service is reserved for natural persons who are adults (18 years and over) and have the legal capacity to contract. By creating an Account, the User declares that they meet these conditions.

Account security

The User is solely responsible for keeping their credentials confidential and for any activity carried out from their Account. Any unauthorised use must be reported without delay. Tire-Bouchon cannot be held liable for fraudulent access resulting from the User’s failure to meet this obligation.

Third-party authentication

The User may create an Account or sign in through third-party services (in particular Google). In that case, use of those services is also subject to the relevant provider’s own terms.

05Description of the service

Tire-Bouchon offers personal wine cellar management features, in particular: bottle recognition from a label photograph, storage and tracking of bottles, estimation of a drinking window (“peak maturity”), food and wine pairing suggestions, informational content about wines, regions and grape varieties, and social features (friends, sharing, messaging).

The Service is provided “as is” and evolves continuously. Tire-Bouchon reserves the right to add, modify or remove any feature at any time, without this giving rise to any right to compensation.

06Artificial intelligence & indicative nature of the information

Certain features rely on artificial intelligence technologies and automated models, in particular: identifying bottles from photographs, estimating peak maturity periods, pairing suggestions, and enriching entries.

No warranty of accuracy

The User acknowledges and accepts that the results produced by these systems are provided for information purposes only. They may contain errors, inaccuracies, omissions or incorrect results (“hallucinations”). Tire-Bouchon does not warrant the accuracy, completeness or fitness of this information for any particular purpose.

  • The identification of a wine, its vintage or its producer may be wrong and must be verified by the User.
  • Peak maturity windows and cellaring advice are statistical estimates, not certainties; actual ageing depends on many factors (storage conditions, vintage variability, and so on).
  • Food and wine pairings are suggestions and a matter of personal taste.

Not professional advice

The information provided by the Service in no way constitutes professional oenological, medical, nutritional or financial advice (in particular as to the value of bottles). Any decision taken on the basis of this information is the User’s sole responsibility.

Data processed by AI

Photographs and data submitted may be processed by third-party technical providers supplying the AI models, in compliance with applicable regulations and with our Privacy Policy.

07Pricing and pricing changes

Access to the Service is provided according to the offers and prices in force, as displayed on the website. Tire-Bouchon expressly reserves the right, at any time and at its sole discretion:

  • to introduce or modify paid offers, subscriptions or premium features;
  • to change prices, the pricing structure or the terms of existing offers;
  • to change the scope of the features made available.

Any price change applicable to an ongoing service will be brought to the User’s attention by appropriate means (email or in-Service notification) before it takes effect. The User remains free to decline a new paid offer by ceasing to use the feature concerned or by deleting their Account. The specific terms of paid offers — price, free trial, billing, renewal, cancellation, right of withdrawal and refunds — are set out in the Terms of Sale, which form an integral part of these Terms.

08User content and contributions to the database

Responsibility for content

The User remains responsible for the Content they publish. They warrant that they hold the necessary rights and undertake not to publish any unlawful, misleading, defamatory or infringing content, or any content that violates third-party rights.

Licence to use

By publishing Content, the User grants Tire-Bouchon a non-exclusive, worldwide, royalty-free licence to host, reproduce, display and adapt that Content solely to the extent necessary to operate and improve the Service, for the duration of use and for the time needed to remove it.

Contributions to the database

The User may propose the creation or correction of entries (wines, producers, and so on). These contributions are subject to validation by the publisher, who may freely accept, modify, merge or delete them in order to ensure the quality and consistency of the Database. A submitted entry may be visible before validation. Contributions become part of a shared database and confer no ownership right or remuneration on their author.

What happens to contributions when an account is deleted

The User may delete their Account at any time from the application or the website. Contributions already added to the Database remain there after deletion, in anonymous form: wine entries created, label photographs that have become the public image of a cuvée, and corrections proposed and then applied. They are permanently detached from their author’s identity, who is no longer named in them.

This retention is necessary for the integrity of the Service: other Users’ cellars rely on these entries, and removing them would destroy third-party content. All other User data — account, cellar, tastings, lists, messages — is deleted. Details are set out in the privacy policy (section 9).

Moderation

Tire-Bouchon reserves the right to remove any Content and to suspend any Account in the event of a breach of these Terms, without notice where the seriousness of the breach justifies it.

09Intellectual property

The Service, its trademark, logo, visual identity, texts, interfaces and databases are protected by intellectual property law and remain the exclusive property of the publisher or its partners. Nothing in these Terms transfers any of those rights.

Any unauthorised reproduction, extraction, substantial re-use or exploitation of the Service or of the Database is prohibited.

10Personal data

Tire-Bouchon processes personal data as part of the Service (account, photographs, content, usage). The details of that processing, its purposes, retention periods and the User’s rights (access, rectification, erasure, portability, objection) are set out in the Privacy Policy, which forms an integral part of these Terms.

The User may exercise their rights and delete their Account at any time from their settings or by contacting the publisher.

11Alcohol, health and responsible use

Excessive drinking is harmful to health. Please drink responsibly. The Service is aimed exclusively at an adult and informed audience. Its purpose is cellar management, information and oenological discovery; it constitutes neither an incitement to consume nor health advice.

The User remains the sole judge of, and solely responsible for, their consumption. Tire-Bouchon disclaims all liability for the consequences of alcohol consumption.

12Availability and maintenance

Tire-Bouchon endeavours to keep the Service available but cannot guarantee continuous, uninterrupted access. The Service may be temporarily suspended for maintenance or updates, or as a result of technical constraints beyond the publisher’s control.

The publisher cannot be held liable for unavailability, slowdowns or data loss resulting in particular from force majeure, network failure or third-party provider failure.

13Limitation of liability

To the extent permitted by law, the Service is provided “as is” and “as available”. Tire-Bouchon does not warrant that the Service will be error-free or that it will meet all of the User’s expectations.

Tire-Bouchon cannot be held liable for indirect damages (loss of data, loss of opportunity, commercial or financial harm) arising from the use of, or inability to use, the Service, nor for decisions taken on the basis of the information provided, in particular information produced by artificial intelligence (see article 6).

Nothing in these Terms excludes or limits the publisher’s liability in cases where such a limitation would be prohibited by law (in particular in the event of wilful misconduct, gross negligence or personal injury).

14Term, suspension and termination

These Terms apply throughout the period of use of the Service. The User may stop using the Service and delete their Account at any time, without having to contact us: from the application (Settings › Delete my account) or from the website (Settings › Account). Deletion is immediate and permanent.

Tire-Bouchon may suspend or terminate a User’s access, without compensation, in the event of a breach of these Terms, fraudulent use, or conduct harmful to the Service or to third parties. Deleting the Account results in the erasure of the associated data under the conditions set out in the Privacy Policy, subject to contributions incorporated into the shared Database.

15Changes to these Terms

Tire-Bouchon may amend these Terms at any time in order to adapt them to changes in the Service or in applicable regulations. The applicable version is the one in force on the date the Service is used. In the event of a substantial change, the User will be informed by appropriate means. Continuing to use the Service after notification constitutes acceptance of the amended Terms.

16Governing law and jurisdiction

These Terms are governed by French law. In the event of a dispute, and failing an amicable settlement, the French courts shall have sole jurisdiction, subject to mandatory consumer protection rules.

In accordance with articles L.611-1 et seq. of the French Consumer Code, a consumer User may, for any dispute relating to a paid offer, refer the matter free of charge to a consumer mediator with a view to an amicable settlement. The details of the competent mediator are provided on request at contact@tire-bouchon.app.
